Introduction
Welcome to MiPharmacy Bondi Junction (ABN 678 980 259) (MiPharmacy, we, us, our). We operate the website at MiPharmacy.com.au and provide pharmacy services, including the dispensing, supply and delivery of Medicine.
These Terms apply to everyone who uses our Services or browses, accesses, or provides information to us, including on or through our Platforms (collectively and individually, You or Your).
In these Terms:
Terms means these terms of supply and use, our Privacy Policy, and any other agreement with us that You accept.
ACL means the Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
Medicine means a therapeutic good we dispense or supply to You, including any Pharmacist Only Medicine, Pharmacy Medicine, Prescription Medicine or other scheduled poison, and any unapproved therapeutic good supplied under a lawful access pathway (including the Special Access Scheme or by an Authorised Prescriber).
Prescription Medicine means a Medicine that may lawfully be supplied only on and in accordance with a valid Prescription, including a Medicine included in Schedule 4 or Schedule 8 of the Poisons Standard.
Prescription means a valid and lawful prescription (including an electronic prescription or active script list entry, and any associated token) issued to You by a Prescriber.
Prescriber means the authorised health care practitioner who issues Your Prescription, whether through a Partner Clinic or otherwise.
Partner Clinic means any clinic or telehealth service (such as our partner clinic) that refers a Prescription to us, or with whom we work to facilitate the dispensing, supply and delivery of Your Medicine.
Platform means any one or more of the websites, digital media and service platforms we use to provide the Services.
Products means any goods we offer for supply, including Medicines and non-medicine products.
Services means the services we provide as described in these Terms, including the dispensing, supply and delivery of Medicine and Products, and associated pharmacy services.
Staff means people employed or contracted by us to provide the Services, including our pharmacists.
Fees means the amounts we charge for Products and for delivery.
These Terms operate together with our Privacy Policy and any other terms or notices we publish on the Platform, each of which is incorporated into the Terms. If You do not agree to the Terms, You must not use the Services.
No Emergency Service
Our Services are not intended for medical conditions requiring immediate, emergency or urgent care. If You require urgent medical assistance, call emergency services on 000 or go to the nearest hospital emergency department.
Should any Staff identify serious concerns for the immediate welfare of an individual, or believe a person may be a danger to themselves or others, our Staff may inform emergency services of those concerns.
Our Services
We are a registered Australian pharmacy. We dispense, supply and deliver Medicine and Products, and we work with Partner Clinics and other Prescribers to facilitate You ordering, purchasing and receiving Your Medicine.
We provide pharmacy services only. We do not provide medical, diagnostic or telehealth consultation services and we do not prescribe Medicine. Prescriptions are issued by Your Prescriber (which may be a practitioner at a Partner Clinic or any other authorised practitioner). Consultations with, and Fees charged by, a Partner Clinic are governed by that clinic’s own terms and are separate from these Terms.
Where You authorise a Partner Clinic or Prescriber to send us Your Prescription, or where You provide Your Prescription to us directly, You authorise us to receive and use that Prescription and the associated information to dispense, supply and deliver Your Medicine.
Important Health Notice
Information made available on the Platform is general in nature, is provided for Your convenience only, and is not medical, pharmaceutical or health advice and is not a substitute for advice from Your Prescriber, pharmacist or other qualified health professional. Always read the label and any consumer medicine information, use Medicine only as directed, and seek professional advice if symptoms persist or You have any concerns.
Use of the Platform does not create a practitioner–patient relationship. A pharmacist–patient relationship arises only when our pharmacist accepts and dispenses a Prescription or provides a pharmacy service to You.
Prescriptions and Dispensing
We may supply a Prescription Medicine only against a valid Prescription and only where it is lawful to do so. You must provide, or authorise a Partner Clinic or Prescriber to provide, a genuine, valid and current Prescription (including any required electronic prescription token or active script list consent) for each Prescription Medicine You order.
You warrant that any Prescription provided to us is genuine, has been lawfully issued to You, has not been altered, and is for Your own treatment or that of a person for whom You are an authorised carer or agent. Medicine is strictly for the personal use of the person to whom it is prescribed, and You are responsible for ensuring that no other person accesses or consumes Medicine prescribed to You.
Our pharmacist must exercise independent professional judgement. We may, in our absolute discretion and in accordance with our professional and legal obligations, decline to dispense or supply any Medicine, reduce a quantity, or require further information, identification or counselling, including where our pharmacist has concerns about the validity of a Prescription, clinical appropriateness, safety, potential misuse or diversion, supply frequency, or compliance with the Poisons Standard, real-time prescription monitoring requirements (including SafeScript NSW), or any applicable law. Where we decline to supply, we will refund any amount paid for the Medicine not supplied.
Supply of Schedule 4 and Schedule 8 Medicines is subject to additional legal controls. We may be required to verify Your identity, record certain information, comply with real-time prescription monitoring obligations, and impose conditions on delivery.
The Platform does not advertise, promote or recommend any Prescription Medicine to consumers, and nothing on the Platform is intended to constitute an advertisement of a Prescription Medicine for the purposes of the Therapeutic Goods Act 1989 (Cth) or the Therapeutic Goods Advertising Code. Any reference to a Prescription Medicine is provided solely to enable the lawful dispensing of a Medicine that has already been prescribed to You.
Your Obligations
Using our Services. By accessing our Platform and using our Services, You agree to comply with and be bound by these Terms, including our Privacy Policy. If You do not agree, You must stop using our Services.
Eligibility. Our Services are only available to You if You: are at least 18 years of age; are currently living in Australia and have an Australian residential address; are obtaining Medicine for Yourself, or for a person for whom You have the legal authority to do so; and have the legal right, authority and capacity to agree to and abide by the Terms. You warrant that each of these matters is true and correct each time You use our Services and access our Platform.
Accurate information. You must provide accurate, current and complete information about Yourself to access our Platform and use our Services, including Your full name, date of birth, contact details, delivery address, payment details, and any Prescription, Medicare or concession details and other information we reasonably require. You must keep this information up to date. If the information You provide is incomplete or inaccurate, we may not be able to provide the Services to You.
Access and security. You must maintain the confidentiality of Your account credentials, take all reasonable steps to ensure a third party does not gain access to the Platform in Your name, and use a secure and private environment to protect Your information. You must notify us immediately if You become aware of any unauthorised use of the Platform in Your name or any other breach of security.
Appropriate use. When using the Platform and our Services, You agree that You will not: use our Services to engage in any fraudulent or unlawful activity; provide false, misleading or inaccurate information, including in relation to Your identity, age, eligibility or any Prescription; obtain or seek to obtain Medicine other than for legitimate therapeutic use by the person entitled to it, or in a manner that constitutes misuse, diversion or doctor shopping; share inappropriate, offensive or illegal content; treat our Staff with anything other than respect and courtesy, or use abusive or threatening language or behaviour; or interfere with, disrupt or gain unauthorised access to the Platform or our systems, or introduce any malicious code.
Authorised representative. You may nominate a representative to assist You in Your dealings with us, including with Medicine orders and enquiries. Additional documentation may be required. You are solely responsible for the conduct of Your Authorised Representative in using our Services.
Orders and Supply
Your submission of an order is an offer to purchase the relevant Products subject to these Terms. All orders are subject to acceptance by us and to availability.
No contract for the supply of a Product is formed until we accept Your order. We accept Your order when we confirm dispatch or supply of the relevant Product (and, for a Prescription Medicine, when our pharmacist accepts the relevant Prescription for dispensing). An order acknowledgement or payment receipt does not by itself constitute acceptance.
We may refuse, cancel or limit any order (in whole or in part) at any time before acceptance, including where a Product is unavailable, where there is an error in pricing or description, where supply would be unlawful or clinically inappropriate, or where we suspect fraud or misuse. We may impose quantity limits on, or restrict the supply of, any Product. If we cancel an order for which You have paid, we will refund the amount paid for the cancelled Product.
Fees and Payment
Prices for Products are displayed on the Platform in Australian dollars and, unless stated otherwise, include GST where applicable but exclude delivery charges, which are displayed before You complete Your order.
Our Fees are for Products and delivery only. They do not include any consultation or clinic fee charged by a Partner Clinic or Prescriber, which is separate and payable to that clinic or Prescriber under its own terms.
You must pay for Products and any delivery charges at the time of ordering using a payment method we accept, unless we agree otherwise in writing. Payments may be processed by third party payment providers, and You authorise us and those providers to charge Your nominated payment method.
We may change prices at any time before we accept Your order. Where a Product is subsidised under the Pharmaceutical Benefits Scheme or another scheme, supply is subject to Your eligibility and that scheme’s requirements. Where an obvious pricing or availability error occurs that You could reasonably have recognised as an error, we are not obliged to supply at the incorrect price and may cancel the affected order and refund any amount paid.
Delivery
We deliver within Australia only. Estimated delivery methods, costs and timeframes are displayed on the Platform or at checkout and are estimates only.
Risk in a Product passes to You on delivery to the address You nominate (or to a person who appears authorised to accept delivery at that address). Title passes to You on the later of delivery and our receipt of payment in full.
You must provide a complete and accurate delivery address and ensure someone is available to accept delivery where required. We are not responsible for delays or non-delivery resulting from incorrect or incomplete address details or a failure to collect.
Certain Medicines, including Schedule 4 and Schedule 8 Medicines and temperature-sensitive Products, may be subject to additional delivery conditions, including identity verification, an adult signature on delivery, restrictions on leaving Products unattended, and cold-chain handling. We may decline to deliver where these conditions cannot be met, and will arrange an alternative method or a refund.
You must inspect Products on delivery and notify us promptly of any item that is damaged, incorrect or missing.
Returns, Refunds and Cancellations
For health, safety and legal reasons, Medicines and certain other Products cannot be returned or exchanged once they have left our premises, except where required by law (including under the ACL). This does not limit Your rights under the ACL.
If a Product is faulty, not of acceptable quality, not fit for a disclosed purpose, or otherwise does not meet a consumer guarantee under the ACL, You may be entitled to a remedy. Please contact us as soon as You become aware of the issue and follow our instructions for handling, returning or safely disposing of the affected Product. Where we agree to a refund, we will process it using the original payment method within a reasonable time.
You may request cancellation of an order before it is accepted by us. Once a Prescription Medicine has been dispensed, it generally cannot be cancelled.
Once we have accepted Your order (as described in Orders and Supply above), the order cannot be cancelled and no refund will be provided, except to the extent required by law (including under the ACL). For a Prescription Medicine, we accept Your order when our pharmacist accepts the relevant Prescription for dispensing.
Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on You by the ACL or any other law that cannot lawfully be excluded, restricted or modified (a Non-excludable Right).
Our goods and services come with guarantees that cannot be excluded under the ACL. For major failures You are entitled to a replacement or refund and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
To the extent we are able to limit our liability for failure to comply with a consumer guarantee (other than a guarantee as to title, undisturbed possession or undisclosed securities), our liability is limited, at our option, to: (a) for goods, the replacement or repair of the goods, the supply of equivalent goods, or payment of the cost of doing so; and (b) for services, the re-supply of the services or payment of the cost of having them re-supplied.
Release or Transfer of Prescription
You may request in writing that a Prescription (or remaining repeat or token) held by us be released or transferred to You or to another pharmacy. We will endeavour to action Your request, to the address or pharmacy You nominate in writing, within 5 business days, subject to any legal requirements applying to the relevant Medicine.
Intellectual Property
All content and materials available through the Platform, including text, graphics, the website name, code, images and logos (Our Content), are our property or licensed to us and are protected by applicable law. MiPharmacy and our logos are our trade marks. We grant You a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and Our Content for the purpose of using the Services in accordance with these Terms. Any other use is prohibited without our prior written consent, except as permitted by law.
Communications
By using the Services, You agree that we may send You service and transactional communications relating to Your account, Prescriptions, orders, dispensing and delivery, by SMS, email, push notification or other reasonable means. These communications are necessary to provide the Services and are not marketing communications.
We will only send You marketing communications by SMS or email where You have opted in to receive them. You may opt out at any time using the unsubscribe facility in the message or by contacting us, and opting out of marketing will not affect the Services we provide to You. Every marketing message will identify us as the sender and include a simple means to unsubscribe.
We comply with the Spam Act 2003 (Cth). As many Medicines are available only on prescription, our communications will not advertise or promote Prescription Medicines to You contrary to the Therapeutic Goods Act 1989 (Cth) or the Therapeutic Goods Advertising Code.
Privacy
We value Your privacy and work hard to protect the information You provide to us. Our Privacy Policy is incorporated into the Terms and sets out how we collect, use, store, disclose and dispose of Your personal information, including health information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the Services, You acknowledge that You have read our Privacy Policy.
Limitation of Liability, Disclaimer and Indemnity
Nothing in this section excludes, restricts or modifies any Non-excludable Right, and our liability for a failure to comply with a consumer guarantee is dealt with under Australian Consumer Law above. Subject to that:
Other than as expressly set out in these Terms, we make no express or implied warranties in relation to the Services or the Platform, and Your use of the Platform is at Your own risk. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that information on the Platform is complete, current, suitable or accurate. Information and statements on the Platform are for informational purposes only and are not intended to diagnose, treat, cure or prevent any disease, injury or illness, and are not a substitute for professional medical or pharmacist advice.
To the extent permitted by law, we are not liable to You for any indirect, incidental, special or consequential loss, or any loss of profit, revenue, data, goodwill or anticipated savings, however arising; and our total aggregate liability to You arising out of or in connection with these Terms or Your use of the Services, whether in contract, tort (including negligence), under statute or otherwise, is limited to the amount paid by You for the Product or Service giving rise to the liability. Our liability is reduced to the extent that Your act or omission (or that of a person for whom You are responsible) caused or contributed to the loss, including any failure to use a Product as directed or to follow professional advice.
To the extent permitted by law, You indemnify us, our related entities, and our and their officers, employees, agents and third-party service providers against any loss, cost, expense or damage (including legal costs on a full indemnity basis) which any Indemnified Party suffers or incurs as a direct or indirect result of: (a) any breach by You of any representation, warranty or term of these Terms; (b) Your provision of false, misleading or unlawful information, including in relation to any Prescription; (c) Your infringement of a third party’s intellectual property rights arising from content You provide; or (d) Your violation of any law. This indemnity does not apply to the extent the liability arises from our negligence or breach of these Terms.
Termination
We may suspend, restrict or terminate Your use of the Platform and cease providing the Services if You fail to comply with, or breach, these Terms, or where required by law or for security, safety, clinical or operational reasons. Termination does not affect rights or obligations accrued before termination, and any provisions that by their nature should survive will survive.
General
We may amend these Terms at any time. All amendments are effective from the date they are published on the Platform or otherwise notified to You. By continuing to use the Services or access the Platform, You agree to be bound by the amended Terms.
These Terms set out the entire agreement between You and us in relation to the Services and Your use of the Platform. If any provision is found to be invalid or unenforceable, it will be read down or severed to the extent necessary without affecting the remaining provisions. A failure or delay by us to exercise a right is not a waiver of it.
We may assign, novate or transfer our rights and obligations under the Terms, including to a successor or purchaser of our business. You must not assign Your rights or novate or transfer Your obligations without our prior written consent.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control. We may give You notices via the Platform, by email to Your registered address, or by other reasonable means.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts located in New South Wales.
